Legislative and Litigation Overview of Five-Month Abortion Laws Enacted Before or After 2010

Since January 2010, twenty-one states have enacted statutes prohibiting abortion at 20 weeks of pregnancy, roughly five months or more than halfway through pregnancy. All but one of these laws make at least some explicit reference to fetal pain in either the title, findings, statement of purpose or intent, definitions, substantive provisions, or some combination of these legislative elements.

Abortion Reporting: Arkansas (2018)

Arkansas’ abortion report for 2018 was published on the website of the Arkansas Department of Health in June 2019. The report shows that the increase in chemical abortions that began in 2007 continued into 2018.

Abortion Reporting: Oklahoma (2018)

Oklahoma’s 2018 abortion report was published in May 2019 on the Oklahoma State Department of Health website. The report shows that total abortions in Oklahoma have increased for the second year in a row after a decade of decline.

Abortion Reporting: Connecticut (2018)

Connecticut’s annual abortion report for 2018 shows that abortions in the state declined from the previous year. Because the abortion report is not published online, the Connecticut Department of Public Health provided it to the Charlotte Lozier Institute (CLI) upon request.

Abortion Cases in the Higher Federal Courts

While several states have appealed court decisions enjoining abortion restrictions to the United States Supreme Court, the Court has thus far failed to clarify or modify federal abortion jurisprudence. Specifically, the Court has declined to review an Eleventh Circuit Court decision enjoining a second-trimester dismemberment abortion ban in Alabama, and a Seventh Circuit Court decision enjoining a ban on discriminatory abortions in Indiana.

Abortion Reporting: Virginia (2016)

In 2016, there were 17,058 abortions reported in Virginia, a drop of nine percent from the 18,663 reported the previous year. Since 2005, Virginia abortions have fallen by 35 percent. There were 4,991 chemical abortions reported in Virginia in 2016, an increase of 240 percent since 2005 but a decline of three percent from 2015.

Massachusetts HB 3320: Sweeping Away Commonsense Protections for Women and Children

The Massachusetts legislature is currently considering a proposal to further liberalize the law of abortion in the Bay State. HB 3320 would substantially alter Massachusetts law by removing any recognition of an unborn child as a person—or even potential person—worthy of protection.

There were 54,507 Texas abortions in 2016, down 1.4 percent from 2015 and down 30 percent from 2001.
