Lozier Library – Terms of Use
Each user must agree to the Terms of Use as a condition of use of the Lozier Library database. The Terms of Use are as follows:

TERMS OF USE
All authorized users of the Lozier Library for Life, Science & Law (“Lozier Library”) must agree to the following Terms of Use. Acceptance of the Terms of Use is a condition for gaining access to the Lozier Library database. By accessing the database, you acknowledge that you have read the Terms of Use and agree to be bound by them. As an authorized user, you acknowledge these Terms of Use may be modified from time to time and agree to be bound by any modified Terms of Use after they have been posted by the Lozier Library.
The Terms of Use represent an enforceable agreement between the authorized user and Susan B. Anthony List Education Fund dba Charlotte Lozier Institute.
Acceptable Use. The Lozier Library is a proprietary database of medical, scientific and legal resources. As an authorized user, you agree to hold confidential and not disclose to anyone who is not an authorized user: (1) the configuration of the Lozier Library; and (2) other specifics to include documents held or cited in the database, and user comments entered in the database, as well as identities of authorized users. You agree to use the Lozier Library database only for the purpose of furthering the prolife cause, as interpreted in accord with published positions of Charlotte Lozier Institute.
Disclaimers and Warranties. THE LOZIER LIBRARY IS PROVIDED “AS IS” AND WITHOUT ANY WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, NON-INFRINGEMENT, OR THAT THE LOZIER LIBRARY WILL BE UNINTERRUPTED OR ERROR-FREE, OR WARRANTIES AS TO THE COMPLETENESS OR TIMELINESS OF THE LOZIER LIBRARY OR ANY CONTENT THEREIN.
Medical Information. The Lozier Library may contain information relating to medical and health topics. All information provided through the Lozier Library is for informational purposes only and should not be a substitute for obtaining proper medical, legal, or other professional care or services. You should not take any action based upon any information contained on the Lozier Library without seeking independent professional advice from a person who is licensed and/or knowledgeable in the applicable field. You should not use any information on the Lozier Library to diagnose a health problem or disease. You should always consult with a physician.
Code of Conduct. As an authorized user, you agree not to interfere with the operation of the Lozier Library database, or with another authorized user’s access to the database. You agree not to transmit unlawful, hazardous, threatening, harassing or obscene language or images in using the database. You agree not to download the database or otherwise substantially and systematically reproduce it or the documents within it. You agree not to attempt to access any section of the database to which you have not been granted access, or to give others who are not authorized users access to the database. The Lozier Library may terminate your access to the database at anytime in the sole discretion of the Lozier Library. You agree to notify Lozier Library staff immediately if you believe someone who is not an authorized user has learned your username or password.
Limitation of Liability. TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL LOZIER LIBRARY BE LIABLE FOR ANY: (A) DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR (B) DAMAGES FOR LOST REVENUE OR PROFITS, LOSS OF OPPORTUNITY, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, WHETHER BASED IN WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE LOZIER LIBRARY HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE. IN THE EVENT THE FOREGOING LIMITATION OF LIABILITY IS DETERMINED BY A COURT OF COMPETENT JURISDICTION TO BE UNENFORCEABLE, THE LOZIER LIBRARY’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OF USE SHALL BE LIMITED TO ONE HUNDRED DOLLARS (US $100).
Indemnification. You agree to defend, indemnify, and hold harmless the Lozier Library for Life, Science & Law, Charlotte Lozier Institute, Susan B. Anthony List, including their related entities, respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Lozier Library.
Third-Part Sites and Content. The Lozier Library database may include links to other sites or pages on the Internet that are owned and/or operated by third parties. Inclusion of these links or any other reference to third parties, products, services, or entities does not constitute an implied or expressed recommendation or endorsement by Charlotte Lozier Institute, Susan B. Anthony List, these entities’ employees or other associates. As an authorized user of the Lozier Library for Life, Science & Law, you acknowledge that you are bound by the Terms of Use for third-party sites and content you access and agree to comply with said Terms of Use. You acknowledge the Lozier Library for Life, Science & Law is not responsible for third-party sites or content, or its availability.
Viruses, Worms, Bots and Botnets. As an authorized user, you agree not to employ viruses, worms, bots and other like devices or code in connection with your use of the Lozier Library database. You agree not to employ viruses, worms, bots, botnets and other like devices or code in an attack on the Lozier Library database. The Lozier Library for Life, Science & Law reserves the right to terminate access for any user whose identity may be linked to the use of viruses, worms, bots, botnets and other like devices or code, at the sole discretion of Lozier Library staff.
Governing Law and Jurisdiction. The Lozier Library for Life, Science & Law, Charlotte Lozier Institute and Susan B. Anthony List are headquartered in the Commonwealth of Virginia. As an authorized user, you agree use of the Lozier Library database will be governed by Virginia law, without regard to conflict of law principles. You agree that any legal proceeding connected with the use of the Lozier Library database will be conducted in the state or federal courts for Arlington, Virginia.
Limitation on Time to File Claims. Any cause of action or claim you may have arising out of these Terms of Use and your access to the Lozier Library must be commenced pursuant to these Terms of Use within one (1) year after such cause of action or claim accrues. Otherwise, such cause of action or claim is permanently barred.
Other Terms. If any provision in these Terms of Use for the Lozier Library for Life, Science & Law is deemed unenforceable, the remainder of these Terms of Use shall not be affected thereby and shall remain valid and enforceable.
