SCOTUS Upholds Indiana Fetal Remains Law, Denies Cert on Discriminatory Abortion Ban

Today the U.S. Supreme Court reversed a lower court ruling and upheld an Indiana law, signed by then-Governor Mike Pence, requiring the humane and dignified disposition of human fetal remains. In the same opinion, without expressing any opinion for or against the law, the Court also denied review of Indiana’s prenatal nondiscrimination law, also signed by Pence, protecting unborn children from eugenic and other discriminatory abortions, such as those carried out on the grounds of race, sex, or conditions like Down syndrome.

CLI has analyzed data from 37 states that released abortion reports for 2017 by April 2019, more than a year and a half ahead of the CDC’s established timetable. Together, these 37 state reports allow for an early peek at U.S. abortion trends at the national level and suggest that, among other developments, the decades-long decline in U.S. abortions may be slowing.

The 2019 legislative session has been a busy time for physician-assisted suicide activists and their adversaries. In the first three and a half months of 2019 alone, 20 states introduced legislation to legalize or expand physician-assisted suicide. Of those states, 11 defeated legislation and one, New Jersey, legalized assisted suicide. Nine states still have active legislation.

Federal Appeals Court Upholds Kentucky’s Informed Consent Ultrasound Law

On April 4, 2019 the U.S. Court of Appeals for the Sixth Circuit upheld Kentucky’s “Ultrasound Informed Consent Act,” also known as House Bill 2 (“H.B. 2”). The opinion draws heavily from the 2018 Supreme Court ruling in the NIFLA v. Becerra pregnancy help center case. In upholding Kentucky’s ultrasound informed consent law, the Sixth Circuit delivers an important victory for one of the great public policy achievements of the pro-life and pro-woman movement.
