Impact of the Strict Scrutiny Standard of Judicial Review on Abortion Legislation Under the Kansas Supreme Court’s Decision in Hodes & Nauser v. Schmidt

This paper is focused on a narrow matter, namely, the nature of the standard of judicial review adopted by the Kansas Supreme Court in Hodes & Nauser v. Schmidt.[2] The most important (and decisive) point to emphasize is that the standard of judicial review adopted by the court in Hodes is so rigorous that it is likely to unsettle existing abortion law in Kansas and result in a legal landscape for abortion in this state that is more permissive of abortion than either the current federal standard or the original federal standard established by Roe v. Wade.

Why the Global Protect Life Rule is Right for the U.S. and Nations Around the World

In January 2017, President Donald Trump took a bold and unprecedented executive action[ii] to restore the Mexico City Policy and extend its reach through Protecting Life in Global Health Assistance (PLGHA), commonly known as the “Global Protect Life Rule.” With this action, President Trump updated and significantly expanded the scope of limitations on U.S. abortion-related funding, also significantly decreasing the amount of taxpayer dollars going to organizations who actively promote or perform abortion. U.S. foreign aid is now better funneled to alternative foreign organizations who are providing necessary healthcare in developing countries, while also respecting these countries’ cultural values and national sovereignty.

An Analysis of How Medicaid Expansion in Kansas Will Affect Abortion Rates

This month, the Kansas state legislature will consider legislation that would expand Kansas’ Medicaid program. Currently, the Kansas Medicaid program does not fund elective abortions. However, in April 2019 in Hodes & Nauser v. Schmidt, the Kansas Supreme Court ruled that access to abortion is a “fundamental right” under the state's Bill of Rights.

The Women’s Health Protection Act of 2019—Ten Things You Need to Know About H.R. 2975

The stated purpose of the Women’s Health Protection Act of 2019 is to protect the ability to perform and obtain abortions. An earlier version of the legislation, introduced in the 113th Congress, was described by one lawmaker’s office as the “Abortion On Demand Act.” H.R. 2975 would supersede and apply to all Federal law notwithstanding any other provision of Federal law, including the Religious Freedom Restoration Act of 1993, and it would trump any State law that conflicts with H.R. 2975. H.R. 2975 is premised on the belief that abortion is “essential” to women’s health and “central” to women’s ability to “participate equally” in economic and social life.

The Supreme Court Has Said It Will Hear a Major Abortion Case from Louisiana. Here’s What You Need to Know.

The U.S. Supreme Court has agreed to hear a major abortion case from Louisiana. The name of the case is June Medical Services L.L.C. v. Gee. The Court is expected to hear arguments on March 4, 2020 and issue a decision by early summer 2020.

“Medicare for All” Means “Abortion for All”

“Medicare for All” Means “Abortion for All”

Advocates for taxpayer-funded abortion likely underestimated the backlash they would face when they attempted to include abortion funding and coverage in healthcare reform in 2010. Ultimately, the Affordable Care Act’s (ACA) abortion-related provisions and accompanying federal regulations marked a massive deviation from the long-standing Hyde amendment by allowing abortion-on-demand in federally subsidized insurance plans.

Abortion Cases in the Higher Federal Courts

Our nation’s highest court may soon clarify or modify federal abortion jurisprudence after agreeing to hear June Medical Services v. Gee, a case in which a Fifth Circuit panel upheld a Louisiana law requiring an abortion provider to have admitting privileges at a hospital within 30 miles of his or her practice.

Anti-Discrimination Laws in the Womb: New Momentum for Protection

Something interesting is afoot in recent disappointments for advocates of the right to life.  In a series of cases that may test the appeal of a new jurisprudence on abortion, two federal appeals courts and the Supreme Court itself have turned aside attempts to enact a law banning disability discrimination abortions.
